Please read these Terms of Service carefully before using Fumbl ("the App"). By downloading or using the App, you agree to be bound by these Terms.

Who Makes This App

Fumbl is developed and maintained by Taylor Lilley, an individual developer. References to "I", "me", or "my" in these Terms refer to Taylor Lilley.

The App

Fumbl is an iOS application that detects when your phone is dropped and plays a sound in response. The App is provided for entertainment purposes.

In-App Purchases

Fumbl offers one in-app purchase: the ability to record custom drop sounds, available as a one-time unlock for $0.99.

All purchases are processed by Apple through the App Store. In-app purchases are non-refundable. If you believe you are entitled to a refund, please contact Apple support directly, as Apple handles all billing and refund requests for App Store purchases.

Your Conduct

You agree to use Fumbl only for lawful purposes and in a way that does not infringe the rights of others. You agree not to:

  • Use the App to harass or disturb others
  • Attempt to reverse-engineer or tamper with the App
  • Use the App in violation of any applicable law or regulation

Phone Damage

Fumbl is an app that encourages dropping your phone. I am not liable for any damage to your phone or any other property resulting from dropping your device. Use the App at your own risk. I recommend testing over a soft surface before committing.

Disclaimer of Warranties

The App is provided "AS IS" without warranties of any kind, express or implied. I do not warrant that the App will be error-free, uninterrupted, or free of bugs. Drop detection accuracy may vary based on device model, case type, and surface.

Limitation of Liability

To the maximum extent permitted by applicable law, I shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to damage to your device.

Intellectual Property

The App, including its name, sounds, and code, is the intellectual property of Taylor Lilley. You may not copy, distribute, or create derivative works without permission.

Changes to These Terms

I may update these Terms from time to time. If I make material changes, I will update the "Last updated" date at the top of this page. Continued use of the App after changes constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions.
